VI. PATIENTS 'RIGHTS AND OBLIGATIONS

  1. Patients' rights
    a) The patient has the right to be respected as a human person, without any discrimination. The patient's right to medical information related to the state of health is guaranteed.
    b) The patient has the right to be informed about the available medical services, as well as how to use them.
    c)
        (1) The patient has the right to be informed on the identity and professional status of the health service providers.
        (2) The hospitalized patient has the right to be informed about the rules and norms  which they must comply with during hospitalization.
    d) The patient has the right to
      of  be informed of his state of health, a  the proposed medical interventions, the potential risks of each procedure, the alternatives  being  to the procedures  proposed,  inclusive  on  default of  treatment  and  non-compliance with medical recommendations, as well as data on diagnosis and prognosis.
    e) The patient has the right to
      of  decide  if  he also wants to be informed if the information presented by the doctor would cause him suffering.
    f) The information is

      It has  the right   to  apply  and to receive, at  discharge, a written summary of the investigations, diagnosis, treatment and care provided during hospitalization.

  2. Patient consent for medical intervention.
    a) The patient
      has the right to refuse or stop an intervention  medical  assuming, in writing, the responsibility for his decision, the consequences of refusing or stopping medical acts must be explained to the patient.
    b) When the patient cannot express his will, but a
      intervention  emergency medical,  staff  medical  he has the right  to deduce the patient's consent from a previous expression of his will.
    c) If the patient requires emergency medical intervention, the consent of the legal representative is no longer required.
    d) If consent is required
      representative  legal,  the patient must  to be involved in the decision-making process, as far as his capacity for understanding allows.
    e)
       (1) In  case  in which  providers  of  medical services  considers that the intervention is in the interest of the patient,  and the representative  legally refuses to give  consent, the decision is declined to a specialized arbitration commission.
         (2) The arbitration commission consists of 3 doctors for hospitalized patients
    and 2 doctors for outpatients.
    f) Consent
       patient is required for harvesting,  storage,  the use of all biological products taken from his body, in order to establish the diagnosis or treatment with which he agrees.
    g) The patient's consent is mandatory in case of his participation in clinical medical education and
      to research  scientific.

III. The right to confidentiality of information and the patient's privacy.
a) All information on the patient's condition, results of investigations, diagnosis, prognosis, treatment, data
  personal matters are confidential even after his death.
b) Confidential information may be provided only if the patient gives his or her explicit consent or if the law expressly requires it.

  1. Patient's rights to treatment and medical care.
    a)
      (1) If providers are required to select patients for certain types of  treatment that are available in  limited number, selection  it is done only on the basis of medical criteria.
        (2) The medical criteria regarding the selection of patients for certain types of treatment shall be elaborated by the Ministry of Health within 30 days from the date of entry into force of this law and shall be made known to the public.
    b)
      (1) The medical interventions on the patient can be performed only if there are the necessary endowment conditions and accredited personnel.
        (2) It is exempted from the provisions of par. (1) cases  of  expedite  ARISING  in extreme situations.
    c) The patient has the right to terminal care, in order to die with dignity.
    d) The patient
      may be  benefit from family support, al  friends,  of  support  spiritual, material  and  of  tips  throughout care  medical.  At the patient's request,  as far as possible,  the environment of  care and  treatment  will be created as soon as possible  close  of the family one.
    e) The patient
      boarding school  It has  the right to medical services  granted by  by  a  accredited doctor from outside the hospital.
    f)
      (1) The medical or non-medical staff from the sanitary units  not  has the right to put the patient under any form of pressure to determine him to reward him otherwise than provided by the legal payment regulations within the respective unit.
       (2) The patient may offer to employees or the unit where he was cared for additional payments or donations, in compliance with the law.
    g)
      (1) The patient has the right to continuous medical care until his / her health improves or until he / she is cured.
       (2) Continuity  care  it   ensure   through  collaboration  and  partnership  among the different public and non-public medical units, hospital and outpatient, specialized or general medicine, provided by doctors, mid-level staff or other qualified personnel.
    After discharge, patients are entitled to available community services.
    h) The patient
      It has  the right to receive assistance   emergency medical, emergency dental care and pharmaceutical services on an ongoing basis.
    i) The non-observance by the medical staff of the confidentiality of the patient data and of the confidentiality of the medical act, as well as of the other rights of the patient provided in this law attracts, as the case may be, disciplinary, contraventional or criminal liability, according to legal provisions.

  2. Obligations of patients
    a) to register on the list of an accredited family doctor;
    b) to strictly observe the treatment and the indications of the doctor;
    c) to have a civilized conduct towards the medical staff from the unit;
    d) to present to the medical services provider the justifying documents attesting the quality of the insured;
    e) to comply with the provisions of the internal regulations of the unit;
    f) to keep quiet in the salon, hospital not to use noisy entertainment methods (backgammon game, card game or other gambling with stakes);
    h) not to leave the hospital during the hospitalization period. The patient who leaves the hospital without the approval of the attending physician and the head of the ward will be discharged.
